Sportsbet Rules, Terms & Conditions.
These General Rules were last updated on the 16th July 2024 and the updates take effect from that date.
1. General Rules
1.1 Who we are and application of these General Rules
1.1.1. 'Sportsbet.com.au' is the trading name of Sportsbet Pty Ltd (hereafter 'Sportsbet'), ACN 088 326 612, a company incorporated in Australia under the Corporations Act 2001 (Cth)('Corporations Act'). Sportsbet is licensed in the Northern Territory ('NT'), Australia by the NT Racing and Wagering Commission ('NTRWC') to accept bets and wagers (together 'bets') by electronic transmission, 24 hours per day. Sportsbet complies with the NT Code of Practice for Responsible Gambling and the South Australian Responsible Gambling Code of Practice. All references to 'we', 'us' and 'our' in these General Rules ('Rules') are a reference to Sportsbet.
1.2 General
1.2.1 To open a betting account with Sportsbet ('Account') you must be aged 18 years or older and reside in Australia or New Zealand. A 'Member' is a person who holds an Account, and any reference to 'you' or 'your' in these Rules is a reference to a Member.
1.2.2. You agree that the service offered by Sportsbet is the ability to place a bet, win or lose.
1.2.3. By opening an Account, you are deemed to have read and accepted these Rules and Sportsbet's Privacy Policy. You can view the Privacy Policy on Sportsbet's website located at www.sportsbet.com.au, m.sportsbet.com.au, t.sportsbet.com.au, any pages or websites under the 'Sportsbet' brand and any Sportsbet mobile phone or tablet applications that are owned and/or operated by Sportsbet ('Website') or by clicking here.
The personal information (as defined by the Privacy Act 1988) of Sportsbet's customers may only be stored, accessed, used or disclosed offshore where such storage, access, use or disclosure is in accordance with all Australian laws, including the Privacy Act 1988, and Sportsbet's Privacy Policy.
1.2.4. Sportsbet reserves the right to change, amend or add to these Rules and the Privacy Policy at its discretion, and will publish such changes on the Website. You agree that any changes, amendments or additions published on the Website will be taken to be effective immediately. It is the Member's responsibility to ensure that they are aware of the current Rules and Privacy Policy.
1.2.5. You acknowledge and agree that by using, browsing or otherwise accessing Sportsbet’s Website, including where your Account has been migrated to Sportsbet from a third party or related body corporate or where you remain a customer of one of Sportsbet’s related bodies corporate (including BetEasy Pty Ltd) and use Sportsbet’s platform to bet, you agree to be bound by these Rules, the Privacy Policy and any other applicable Sportsbet terms and conditions (‘Terms and Conditions’).
Sportsbet may publish additional information or settlement rules in a ‘market blurb’ from time to time and, unless otherwise expressly stated, these will prevail to the extent of any inconsistency with these Rules or any other Terms and Conditions. Sportsbet will use reasonable endeavours to notify Members of material changes in advance of those changes taking effect.
1.2.6. If you wish to become a registered user of Sportsbet’s Website or app, you will need a user account which is recognised by Sportsbet, which may at our discretion include a user account migrated from third parties and related bodies corporate or an existing account we have approved for use on Sportsbet’s platform (including BetEasy accounts).
1.2.7. You agree that Sportsbet (or third parties authorised by Sportsbet) may send you direct marketing and promotional messages that are relevant to your relationship with Sportsbet. These messages may be sent via different channels, including by email and SMS. You may opt-out of receiving these messages (either altogether or via a particular channel) by updating your contact preferences in your Account, or by using any other unsubscribe facility we provide, in accordance with these Rules and any other applicable Terms and Conditions.
1.2.8. We may appoint an account representative to help manage your interactions with Sportsbet. Subject to your contact preferences, your account representative may communicate with you by email, SMS or phone. Some of these messages may include marketing and promotional material. However, given the personalised nature of these messages, you acknowledge and agree that they may not include an ‘unsubscribe’ or ‘stop’ mechanism. If you wish to stop receiving these messages, you can opt-out or change your contact preferences at any time by replying to the message with the words 'OPT OUT' or otherwise informing your account representative.
1.3. Member obligations
1.3.1. Members are responsible for ensuring that their Account details such as their address, telephone number, email address and payment/bank details (including any Debit card expiration details) are kept up to date and agree to notify us immediately of any incorrect Account details. In the event that a Member has not kept their Account details up to date, we reserve the right to suspend the Account. Members are responsible for complying with their own local, national or state laws concerning betting prior to either applying to become a Member or placing a bet on their Account. For legal and/or commercial reasons, we do not permit Accounts to be opened by, or used from, customers who reside in a country other than Australia or New Zealand.
If you are a resident of a country other than Australia or New Zealand, you must not register with us, attempt to use our services or use your payment card or other payment method to bet with us and you agree that you shall not (whether intentionally or not):
- open an Account;
- use or attempt to use an Account or our services; or
- bypass or attempt to bypass any measures we may use to prevent or restrict access to our services.
1.3.2. We periodically monitor transactions on Accounts. You accept that if we detect activity which indicates to us that you are or may be within a Restricted Jurisdiction and are or may be betting on your Account, we may, in our discretion, either suspend or permanently close your Account. You accept that the data available to monitor betting on an Account is not always accurate and Sportsbet will use its discretion in accepting any bets on your Account while conducting any investigation.
1.3.3. In the event that Sportsbet discovers that an Account has been opened by a person who resides in a Restricted Jurisdiction, Sportsbet may in its discretion close the Account and request proof of payment method, personal identification and bank account information prior to permitting a withdrawal of the original funds. Winnings may be forfeited if the Account holder opens the Account contrary to these Rules.
1.3.4. If you register an Account with Sportsbet, you must then comply with the matters set out in Rules 1.4 (Member identification requirements) to our satisfaction to fully activate your Account and withdraw funds.
1.3.5. You must immediately notify Sportsbet of any matter (including any potential mental impairment) which may lead us to reasonably infer that your ability to make sound judgments about betting in respect of your Account may be impaired.
1.4. Member identification requirements
1.4.1. Members are required to provide Sportsbet with adequate information for the purposes of complying with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) ('Act'). The Act provides for compliance obligations including collecting and verifying of Member’s identification information, with which Sportsbet is required to comply for the purposes of: (a) considering an application to open an Account; and (b) operating an Account including receiving or accepting a bet and paying out winnings. Even after an Account has been opened, the Act requires Sportsbet to collect and verify a Member’s up to date information.
1.4.2. At any time, including after an Account has been opened, Sportsbet reserves the right to request further information from Members to comply with the Act which includes (amongst other things) to further verify their identity, income or assets, source of funds (including origin or funds) and/or financial position. Sportsbet may suspend the Account (or the ability to withdraw funds from the Account) and/or close the Account without prior notification to the Member, where the Member refuses or fails to respond to Sportsbet’s request for Member’s information in order to comply with the Act.
1.4.3. As of 29 September 2023, Sportsbet is required by the Act to verify a Member's ‘identification information’ (‘ID’) (including your full name, residential address and date of birth) before they can transact on their Account. Members who do not provide full details up front may have their Accounts suspended, without notice, pending an investigation. If a Member's Account is opened but not verified, they will be unable to deposit/withdraw funds, place bets or otherwise transact on the account until it is verified. 1.4.4. Upon registration with Sportsbet, the Member accepts and consents to Sportsbet supplying the Member's ID to a third party (e.g., Edentiti, GreenID etc.) for the purpose of ID verification and re-verification (as applicable), which may involve checking the Member's ID against third party databases and/or credit headers. The verification process available is not perfect and we cannot verify all Members in this way. This is not a fault of individual Members. No personal financial information of a Member is passed between third party ID verification providers and Sportsbet. Sportsbet may also use other public information services to confirm a Member's identity.
1.4.5. Sportsbet may require proof of a Member's current address. If the Member's address is not on the front or back of one of the types of photographic identification referred to in Rule 1.4.7, the Member must provide proof of current address acceptable to Sportsbet. Acceptable proof of current address in such circumstances may include, at Sportsbet's discretion, a certified copy (click here for more information) of one or more of the following documents (which must be dated no more than 3 months prior to the date that the Member provides the document to Sportsbet):
a) a rates notice;
b) a utility bill.
1.4.6. All certified documents must be produced in the English language or they will be rejected. Sportsbet reserves the right to carry out checks on the individual certifying documents and to get in touch with them to verify the validity of the document. Sportsbet may in its discretion reject certified documents for any reason.
1.4.7. Sportsbet may at any time request acceptable photographic identification and proof of a Member's current address from a Member to ensure that all information supplied by the Member is up to date. This may require official certification of a Member's ID documents upon our request.
1.4.8. Should a Member deliberately falsify any ID or any other details for any purpose associated with applying for an Account or transacting on the Account, Sportsbet reserves the right to suspend the Account and/or close the Account without prior notification to the Member.
1.4.9. If a Prepaid/Virtual/Electronic/Travel/Debit card is to be used by a Member to fund the Account, legible copies of the front of the applicable card may be requested by Sportsbet at any time. Sportsbet reserves the right at its discretion to refuse to accept a Debit card including but not limited to in circumstances where the Debit card is dishonoured. Debit cards used to fund a Member's Account must match the Member's Account details. Debit cards with a name other than that which is registered with Sportsbet for the Account in question will be refused and the Account may be suspended until proof of consent is provided by the third party cardholder. Provision by the Member of a copy of the front of the card and/or third party consent does not guarantee activation/re-activation of the Account.
1.5. Account security
1.5.1. A Member is responsible for ensuring that their user name and security details (including any personal identification number ('PIN'), password or Account number) ('Secure Member Details') are kept confidential. If a Member suspects that their Secure Member Details may no longer be confidential or that there may have been unauthorised use of their Account, they must notify Sportsbet immediately, and Sportsbet may provide the Member with new Secure Member Details. Where Sportsbet provides the Member with new Secure Member Details, Sportsbet reserves the right to invalidate any future transactions which attempt to utilise the previous Secure Member Details of that Member.
1.5.2. Where a Member wishes for another individual to have access to their Account or any Secure Member Details (including any family member, business or corporate entity or any other person whatsoever) (Nominee), the Member must provide the Nominee’s details to Sportsbet obtain Sportsbet’s prior approvall. Sportsbet may refuse such request for access at its discretion. A Member remains solely responsible for their Account including but not limited to transactions, bets and Account changes made by any authorised individual. Sportsbet reserves the right to request full certified identification documentation from any proposed Nominee.
1.5.3. Members will be responsible for all bets on their Account in which their Secure Member Details are used, subject to Rule 1.11.8 and where Sportsbet, after appropriate investigation and acting reasonably, considers that a bet has been placed without the knowledge and consent of the Member.
1.5.4. Members should check the balance of their Account each time they log on to their Account or at the time they place their bet. In the event of a query, it is the Member's responsibility to notify Sportsbet immediately.
1.5.5. If minors have access to a laptop or computer that a Member uses to log into their Account, Sportsbet strongly recommends that a child protection software package is installed onto that equipment. Two such software applications are Cyber Patrol and Net Nanny.
1.5.6. Sportsbet's Website contains adult content and is intended for use by persons over the age of 18.
1.5.7. In order to use the Sportsbet App, your device location data from your device will be accessed and used by our integrated security systems to alert us to suspicious activity, for the purpose of protecting your account security and preventing fraud.
1.6. Deposits and withdrawals
1.6.1. Deposits into an Account can be made by means of Debit card, BPay (for Australian residents only), cheque or money order, Moneybookers, PayPal (for Australian residents only), direct deposit (available for customers of selected banks only) or telegraphic transfer. Sportsbet reserves the right to remove or restrict payment methods for Members who reside outside Australia.
1.6.2. Sportsbet reserves the right to remove or add payment options from time to time. Current available payment methods can be viewed within the 'My Account' section of our Website when you are logged in to your Account.
1.6.3. If Sportsbet determines, acting reasonably, that funds deposited are not for the purpose of betting, Sportsbet may in its discretion decline the deposit, return the funds to the bank account used to fund the Account, and close the Member's Account.
1.6.4. If Sportsbet determines, acting reasonably, that the funds deposited are not from a funding instrument in the Member’s name or are not expressly authorised to be used by them, Sportsbet reserves the right to decline the deposit and return the funds to the original payment method. If this determination takes place after bets have been placed, Sportsbet reserves the right to void any resulted or pending bets on the Member’s Account.
1.6.5. If Sportsbet determines, acting reasonably, that there is not enough information to prove the owner of a particular payment option, Sportsbet reserves the right to request certified documentation as proof of ownership prior to making any decision.
1.6.6. Sportsbet reserves the right to check directly with the Member’s funding institution that supplied the payment option used to deposit to confirm that the details provided by the Member to Sportsbet are valid and correct.
1.6.7. Sportsbet requires that any deposits into a Member's Account be 'turned over' or 'bet through' at least once prior to authorising a withdrawal from the Member's Account.
1.6.8. Sportsbet reserves the right to waive Rule 1.6.7 should the Member be restricted in stake while placing a bet, if an error is made during a transaction, or for any other reason, determined at Sportsbet's discretion.
1.6.9. By depositing to Sportsbet you accept that at its discretion, Sportsbet may, acting reasonably, require a Member to return the value of their deposit back to the original funding instrument.
1.6.10. Sportsbet must comply with the Act. Should we reasonably consider that a deposit or withdrawal may potentially be fraudulent, we reserve the right to request proof of deposit or withdrawal bank account information to verify that the information provided is true and correct prior to permitting funds to be withdrawn from the Account.
1.6.11. If Sportsbet, acting reasonably, determines that a payment to or from an Account poses risk of being unlawful, Sportsbet reserves the right to cancel the deposit or withdrawal.
1.6.12. Subject to Rule 1.6.13, Sportsbet will not charge Members for Debit card deposit or withdrawal fees, although Sportsbet may, at its discretion, charge a Member the international telegraphic fee incurred by Sportsbet for any international transfers they make (currently A$15.00 per international transfer). This fee may be deducted from the amount requested by the Member. Debit card holders are responsible for any banking fees by their own banking institution on depositing funds with Sportsbet.
1.6.13. Sportsbet reserves the right to pass on to Members any transaction processing fees incurred by us where those fees relate to deposits which we determine, acting reasonably, have been made into their Account by that Member or a person authorised to use their Account for purposes other than betting.
1.6.14. Subject to Rule 1.5.2, you agree that as the account holder, you are the only person permitted to use your Account (including accessing, betting with, depositing funds into, and withdrawing funds from your Account). Third party bank account holders or debit card holders must not transact on an Account that has not been registered in their name. Members must use their own or joint deposit and withdrawal methods. If Sportsbet detects third party payments on an Account, Sportsbet reserves the right to suspend the Account and may request confirmation of permitted use from that third party.
1.6.15. Subject to Rule 1.5.2, if Sportsbet identifies third party transactions on an Account, Sportsbet reserves the right to remedy the situation in its absolute discretion. Members accept that Sportsbet will review each situation on a case by case basis taking into account deposits, withdrawals, bets and any other information available. Members accept that when an Account has not been operated on a good faith basis (including where a person fails to disclose their identity or payment information) Sportsbet may refuse future transactions and either allow or retrospectively void existing transactions at its discretion.
1.6.16. Sportsbet reserves the right to place limits on deposits and restrict or prohibit withdrawals on any Member's Account if the Member has not fulfilled the ID requirements specified in Rule 1.4 until those requirements have been satisfied.
1.6.17. Members are not permitted to open more than one Account with Sportsbet (Supplementary Account(s)). Where Sportsbet identifies that a Member holds a Supplementary Account , Sportsbet will close the Supplementary Account. Supplementary Accounts are in breach of Sportsbet's Rules, however Members are responsible for transactions on all Accounts they hold. This includes transferring self-exclusions and deposit limits to Supplementary Accounts.
1.7. Chargebacks
1.7.1. Members agree and warrant that no chargebacks or other cancellation of deposits will be made relating to their Account without our consent (which will not be unreasonably withheld or delayed). In the event that chargebacks or other cancellation of deposits are made to your Account without our consent, you agree to indemnify us for any costs, claims, damages and expenses relating to or arising in connection with this, including any expense incurred by us in recovering such amounts.
1.7.2. If a Member disputes a financial transaction on their Account relating to a third party (e.g. Bank, eWallet), Sportsbet may temporarily suspend the Account without notice, pending an investigation by us into the transaction. If Sportsbet incurs any loss as a result of a Member unreasonably disputing a financial transaction on their Account relating to a third party, we reserve our right to recover such losses from the Member.
1.7.3. If you use any of Sportsbet banking specific options (BPay/PayID/EFT/CASH or Cheque) you accept that Sportsbet may request a certified or non-certified bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that Sportsbet may decide to return these funds at its discretion and void bets should it deem that the funds may be unauthorized.
1.8. Fraud
1.8.1. Sportsbet reserves the right to withhold deposited funds and/or winnings from resulted bets should it determine that a Debit card has been misused or used fraudulently. Any matters of inappropriate or fraudulent use of any Debit card will be reported to the relevant authority. The Member's Account may also be permanently closed.
1.8.2. Sportsbet may employ third party technologies to track and store technical information on the device that Members choose to use. Members accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, bonus or betting abuse, multiple Account operations, payment method abuse etc.
1.8.3. Sportsbet reserves the right to close the Accounts of, and void any or all bets made by any person, group of people or corporation in an attempt to defraud Sportsbet.
1.8.4. Sportsbet may periodically review Accounts to monitor any activity that it might consider unusual. If unusual activity is detected, Sportsbet reserves the right to suspend an Account pending a full investigation, without notice.
1.9. Provision of live Victorian thoroughbred coverage to Members
1.9.1. Members that are logged into their account in Australia have access to live or near live digital feed of the Victorian thoroughbred racing industry race coverage (‘Live Feed’) for their own personal viewing. Members can also access replays of the Live Feed until midnight on the relevant race day.
1.9.2. The Live Feed is produced and owned by RVL Media Pty Ltd. Members are prohibited from communicating, resupplying, copying, storing or otherwise exploiting the Live Feed including: (a) exploiting the Live Feed in any public place; or (b) for any purpose other than personal viewing by the Member.
1.9.3. The Live Feed is provided through a third party supplier of which Sportsbet has no control. Sportsbet cannot guarantee Live Feed will be available for all Victorian thoroughbred race meetings held at a TAB race meeting conducted by a Victorian Race Club.
1.10. Sportsbet's rights and other matters
1.10.1. Sportsbet reserves the right to cancel, change or restrict the products or bet types at any time with or without notice to Members.
1.10.2. In accordance with its NTRWC Licence Conditions, Sportsbet maintains a separate bank account which contains sufficient funds to match every dollar of Member funds. This requirement is regularly monitored by the NTRWC to ensure compliance.
1.10.3. Sportsbet has made considerable efforts to ensure that its sports betting business operates in a fair, efficient and accurate manner. To the extent permitted by law, Sportsbet excludes all warranties (express or implied) relating to or arising out of the betting services we offer and excludes any liability for direct, indirect or consequential loss, damage, expense or injury suffered by any Member arising out of:
a) the Rules;
b) use by a Member of their Account; or
c) any action taken by Sportsbet in relation to a Member's Account in line with these Rules and any other applicable Terms and Conditions.
1.10.4. Nothing in these Rules affects our liability:
a) to pay any Member winnings or other amounts properly owing to such Member pursuant to these Rules;
b) for death or personal injury arising from our negligence;
c) for our fraudulent misrepresentation; or
d) for any matter in respect of which our liability cannot be excluded or limited under applicable law
1.10.5. Subject to Rules 1.10.3 and 1.10.4, and to the extent permitted by law, Sportsbet's liability in respect of any claim or loss shall be limited in amount to the relevant bet placed by a Member.
1.10.6. A Member may only have one Account. If a Member has additional Account(s), then the Account balances of all associated Accounts shall be transferred into the first Account opened by the Member ('First Account'). Further:
a) if, after such transfers the First Account has a debit balance, then Sportsbet shall be entitled to receive payment immediately upon written request to the Member to clear the debit balance; or
b) if, after such transfers there is a credit balance in the First Account, the credit balance will be held by Sportsbet until such time as a determination has been made by Sportsbet as to whether or not there has been a breach of these Rules.
1.10.7. If, in addition to your Account, you also hold an account with a related body corporate (as defined in the Corporations Act) of Sportsbet ('other account'), you agree that we may set off any amount in your other account against any amount which is due and payable by you in relation to your Account.
1.10.8. If a Member receives a bonus bet that requires a deposit to be made to claim the bonus bet, the deposit and the bonus bet must be turned over (or bet through) at least once. Sportsbet reserves the right to remove the bonus bet and refund the remaining balance should a Member be in breach of these Rules and/or the terms and conditions of the specific promotion. 1.10.9. Sportsbet products and bet types are intended for bona fide Members, that is, those Members who act in good faith, sincerely, without fraud, and who place a bet with Sportsbet for the purpose of recreation and entertainment.
1.10.10. Sportsbet reserves the right, acting reasonably and in good faith, to determine that a Member is not eligible for certain products, bet types or promotions (in part or full).
1.10.11. Sportsbet reserves the right to close or suspend the Accounts (or the ability to withdraw funds from the Account) of , and/or void or allow to stand any or all bets made by any person where, in Sportsbet's reasonable opinion, a person:
-
has sought to open, or is operating, an Account in breach of Sportsbet’s Rules;
- has acted or is suspected of acting unlawfully in relation to their use of the Account;
- knowingly exploits, or intentionally seeks, to exploit a market or a Rule (including by deception);
- seeks to manipulate the outcome of a market (whether or not for personal gain);
- receives an unjust advantage from information which is not known to the public;
- intentionally abuses an inadvertent error in the description of a market (whether before or after Sportsbet corrects the relevant descriptor);
- may have engaged in conduct that raises an integrity concern; or
- opens an Account in circumstances where Sportsbet reasonably suspects the person has previously self-excluded.
1.10.12. For the avoidance of doubt, there is no association between Sportsbet and the Hong Kong Jockey Club. Sportsbet is not licensed, endorsed by or associated in any way with the Hong Kong Jockey Club.
1.10.13. As a responsible bookmaker Sportsbet offers its Member's the ability to control the amount they bet by setting a limit on the amount they can deposit to their Account per day, week or month (referred to as a deposit limit.)
1.11. Placement and acceptance of bets
1.11.1. All bets on an Account are considered to be placed and received in the NT, Australia.
1.11.2. Sportsbet does not represent or warrant that any bet by a Member on their Account or the acceptance of any bet on an Account by Sportsbet complies with the legal requirements of any state or country other than the NT. Members must satisfy themselves (and assume full responsibility for) the legality of:
a) applying to Sportsbet for an Account;
b) remitting funds by Debit card or other permitted means to an Account;
c) placing bets with Sportsbet; and
d) receiving winnings from Sportsbet.
1.11.3. Sportsbet reserves the right at any time, acting reasonably and in good faith, to refuse any bet or part of a bet without providing a reason or advance notification. The circumstances in which Sportsbet may refuse a Member's bet include but are not limited to:
a) a Member is or may be less than 18 years of age;
b) a Member is or may be betting on behalf of a person who is less than 18 years of age;
c) a Member is or may be in breach of these Rules;
d) a Member is or may be in breach of any applicable law; or
e) a Member's proposed bet would present an unacceptable liability risk to our business. Whether there is an unacceptable liability risk to us for the purpose of this Rule is at Sportsbet's discretion.
1.11.4. Sportsbet may, in its absolute discretion, offer the ‘Cash Out feature’ for selected products or bet types. The Cash Out feature, and any bets in respect of which the Cash Out feature is available, are governed by these Rules and the additional rules described here (‘Cash Out Rules’). In the event of any inconsistency between these Rules and the Cash Out Rules, the Cash Out Rules will prevail. By entering into a bet, you acknowledge that:
a. you may not be able to Cash Out your bet at any particular time, or at all, during a bet; and
b. Sportsbet may deny your request to Cash Out your bet without providing a reason or advance notification to you.
1.11.5. Sportsbet reserves the right to close and/or impose limits on a Member's Account (including limits on any Sportsbet products that a Member may wish to bet on but not for the purpose of avoiding the compliance of Minimum Bet Laws (MBL’s) prescribed by racing bodies and refund the balance of their Account, without providing reasons. In this event, Sportsbet will honour any outstanding bets made pursuant to the Account, unless the Member's Account has been used for any fraudulent transaction or purpose, in which case any such bets will be void.
1.11.6. When a Member is placing a bet on their Account via the Internet, it is accepted once the Member submits the bet and a 'betting receipt number' is issued through the Website.
1.11.7. For bets placed by telephone, the Member is responsible for providing the correct Account details (including Account number and password). When a Member places a telephone bet, the bet details will be repeated back to the Member. A bet is accepted if, after the bet details are repeated back, the Member either:
A. Indicates agreement with the bet; or
B. Does not disagree with the bet details before the telephone call ends.
1.11.8. In the event a telephone call by a Member in which a bet is being placed is interrupted for any reason (including a mobile phone dropping out) prior to the conclusion of the call, any unconfirmed bet will be deemed not to have been entered into. In such circumstances, it is the responsibility of the Member to contact Sportsbet promptly to confirm the bet they wish to place.
1.11.9. All telephone calls with Members and any other conversations with Members relating to bets, complaints or Disputes (defined in Rule 1.15)('Dispute Resolution') or Account queries will be recorded. The Member agrees to such recordings being made. Where a Dispute occurs which cannot be resolved between the Member and Sportsbet, the Member agrees that the recording(s) and/or any records of a Member's transactions via the Internet may be made available to the adjudicator of the Dispute to enable the Dispute to be determined in accordance with these Rules. All records of voice recordings will be securely retained by Sportsbet in accordance with Australian privacy law obligations.
1.11.10. Members are unable to change or cancel a bet once the bet has been accepted by Sportsbet unless the Member can demonstrate to Sportsbet's reasonable satisfaction that the initial bet was made in error; in which case Sportsbet may, at its reasonable discretion, void the initial bet and request the initial bet be replaced with another bet.
1.11.11. The minimum bet on the Internet on an Account is $0.01c.
1.11.12. The minimum bet for a single bet or multiple bets on racing on an Account via the telephone (excluding live betting) is a total of $50.
1.11.13. The minimum bet for a single bet or multiple bets on sport (excluding 'live' betting) on an Account via the telephone is a total of $20.
1.11.14. The minimum bet for 'live' betting sporting events on an Account is $5 per bet.
1.11.15. Live betting in these Rules refers to a form of betting whereby the person placing the bet is able to place bets after an event has begun (e.g. betting on the outcome of an AFL football match at half time). In compliance with the Interactive Gambling Act 2001 (Cth) and our NTRWC Licence Conditions, we do not accept live betting over the Internet (other than on horse, greyhound and harness racing) but may accept live betting via the telephone.
1.11.16. Any live betting offered by Sportsbet will be displayed on the Website and Members can call to place a live bet on any markets offered. All live betting markets are subject to their respective pre-match rules. While reasonable effort is made to ensure the accuracy of live scores and the status of games displayed on our Website in connection with live betting, we accept no liability for the incorrect display of this information except to the extent that liability cannot be excluded by law.
1.11.17. Any live betting markets will be displayed on the website as ‘Bet Live’ and will display the Bet Live logo. For details on how to bet live refer to Bet on Sport Live FAQs.
1.11.18. Sportsbet reserves the right to provide an Australian governing sporting body (defined in Rule 1.11.20 below), with:
a) records or documents in the possession or control of Sportsbet relating to betting transactions of the Member; and
b) the name, contact details and similar identifying information in the possession or control of Sportsbet relating to that Member.
1.11.19. Such information will only be provided to assist in a legitimate inquiry conducted by an Australian governing sporting body to maintain the integrity of the sport. For the avoidance of doubt, the Member consents to Sportsbet providing the above information to an Australian governing sporting body.
1.11.20. For the purposes of this Rule, 'Australian governing sporting body' is an Australian sports organisation that has a regulatory or sanctioning function and includes each of the Australian State and Territory Thoroughbred Racing, Harness Racing and Greyhound Racing peak bodies, the Australian Football League, Athletics Australia, the Australian Rugby Union, Cricket Australia, the National Basketball League, the National Rugby League, Swimming Australia and Tennis Australia.
1.12 Sportsbet Max Payouts Terms and Conditions
1.12.1. Sportsbet adheres to all MBLs prescribed by official racing bodies across all three racing codes: Horse Racing, Harness Racing and Greyhound Racing. Sportsbet is not obliged or required to accept a bet to win more than the applicable MBL prescribed amount for the relevant state at the relevant time. In the event of an official price fluctuation or Sportsbet price fluctuation changing, Sportsbet is not compelled to accept any bet at the pre-changed price.
1.12.2. Subject to the provisions of this clause, Sportsbet reserves the right to limit the total winnings payable to any individual customer on any bet type on a single event/selection or on multiple bets which include at least one of the same selection to $1 million ('Maximum Win Limit'). For tote based bet types, Sportsbet reserves the right to limit the maximum winnings payable to the total size of the relevant tote pool for that bet. If a customer places multiple bets on the same or related markets they will only be eligible to win up to the Maximum Win Limit (combined) for those bets. Similarly, if bets are placed by or on behalf of a customer across multiple accounts, the Maximum Win Limit will apply to all bets placed across those accounts. For the avoidance of doubt, the Maximum Win Limit does not impact Sportsbet’s ability to not accept a bet or limit the size of the stake it is willing to accept for a bet, nor does it impact Sportsbet’s ability to rely on and enforce its terms and conditions.
1.13. Errors
1.13.1. Sportsbet endeavours to ensure that no errors are made in setting markets including but not limited to errors in prices offered, available selections offered, bets accepted on an Account or any errors in exclusions for certain selections. However, Sportsbet reserves the right to correct errors and to void any bets prior to or after an event in circumstances where a bet has been accepted and where there has been a material technical, human or other error in setting a market and/or in accepting a bet.
1.13.2. Where a bet is voided by Sportsbet prior to an event commencing, Sportsbet will use reasonable endeavours to contact the Member by email prior to the event to inform them that the bet has been voided.
1.13.3. For the purposes of 1.13.1, an error in setting a market or accepting a bet will be material in any of the following circumstances:
i. the price struck for a bet is materially greater than a price historically offered on the same or a similar market by Sportsbet or a competitor bookmaker;
ii. there is an error in the price of at least one selection which forms part of a multiple bet; the combined effect of which results in a materially erroneous price;
iii. the available selection(s) on a market are so different from the selection(s) historically offered on the same or a similar market by Sportsbet or a competitor bookmaker; or
iv. a person with a good understanding of wagering would reasonably understand that there was an error in a relevant market or in the acceptance of the bet.
1.13.4. For the purposes of 1.13, and in any of the above circumstances:
i. a bet includes a single bet or a multiple bet; and
ii. if the erroneous price or selection is part of a multiple bet placed by a Member, the multiple bet will be either re-calculated at adjusted (correct) prices or by excluding the event to which the error relates, at Sportsbet's absolute discretion.
1.14. Responsible Gambling
1.14.1. Sportsbet:
(a) makes every reasonable effort to prevent self-excluded customers from returning and using our service;
(b) provides pre-commitment facilities to help you control your spend (you can access these via the “My Account” section of our Website); and
(c) provides a self-exclusion facility to help you if you feel that you have developed a gambling problem. At your request, Sportsbet will prevent you from using your Account indefinitely. To this end, Sportsbet may retain such personal information as is necessary (and for as long as is necessary) to implement the self-exclusion facility as effectively as possible, including the following information: your name, address and payment details. For information on problem gambling generally, please follow the links at the bottom of this and/or other pages of the Website.
1.14.2. If you are a self-excluded customer: (a) you must not attempt to open an Account or place any bets with us (using your Account or otherwise); and (b) subject to these Rules if, Sportsbet acting reasonably, considers that you have deliberately circumvented our controls (e.g. by opening a duplicate Account) and placed bets while you are self-excluded: (i) open/pending bets will be voided and the original stake returned to your Account; (ii) resulted bets will stand; and (iii) the balance of your Account will be returned to you; and (iv) you are fully liable for your actions, and for all activity and bets placed on your Account.
1.14.3. Sportsbet marketing and communications are aimed at over 18’s only. Sportsbet does not intend to market to individuals for whom gambling has become a problem.
1.14.4. Sportsbet reserves the right to place enforced actions on your Account in response to a Responsible Gambling review. These actions may include, but are not limited to, the application of deposit limits, breaks or permanent self-exclusion on an Account.
1.15. Dispute Resolution
1.15.1. These Rules shall be governed by and construed in accordance with the laws of the NT and subject to Rule 1.15.2, each Member irrevocably submits to the non-exclusive jurisdiction of the NT Courts in respect of any dispute arising out of or relating to these Rules or the provision by Sportsbet of goods or services to Members ('Dispute').
1.15.2. If any Dispute cannot be resolved between Sportsbet and the Member, the Dispute must be referred to a representative of the NTRWC via the online 'gambling dispute form' for final determination. A Dispute must be lodged with the NTRWC within 14 days of the Dispute arising. The decision of the NTRWC is final and binding on Sportsbet and the Member. Nothing in this Rule precludes a party from seeking urgent interlocutory relief from a Court if such relief is reasonably required.
1.15.3. No rule of contract interpretation may be applied in the interpretation of these Rules to the disadvantage of a party on the basis that it prepared or put forward these Rules or any document forming part of these Rules.
1.16. Inactive Accounts
1.16.1. Your Account will become inactive if you have not made a deposit or placed a bet on your Account for a period of more than 18 months ('Inactive Account'). To keep an Inactive Account open, you must pay a fee of $10 per month ('Administration Cost') which will be deducted from your Inactive Account (unless your Account balance is $0). To avoid the Administration Cost, you can simply either place a bet or withdraw your funds into your bank account. If this occurs your Account will no longer be deemed an Inactive Account.
1.17. Significant Events
To the extent there is any inconsistency between these Rules and any terms and conditions (including market blurbs) applying to a specific market, these following Rules will prevail unless otherwise expressly stated.
1.17.1 Unexpected events and other changes
If an event(s) occurs beyond the reasonable control of Sportsbet such as an epidemic, pandemic, flood, fire, earthquake, element of nature or act of God, act of war, terrorism, riot, rebellion, strike, blockade, labour disruption or other cause, that materially impact any sporting, racing or other event (or a series of events or races in a season) which is the subject of a contingency or outcome of a market offered by Sportsbet, Sportsbet may (acting in good faith) exercise its discretion to void, cancel, restrict or otherwise alter or adjust the payout (in whole or in part) of the affected bet(s) placed on the relevant market (including, without limitation, retrospectively take any of the actions contemplated above once a bet has been struck and before or after it has resulted). For the avoidance of doubt, an 'impact' on any sporting, racing or other event includes, without limitation:
- any reduction in the number of games, matches or race meetings in a season;
- any material change in the length of a game or match or when the matches are played or races are run;
- a material change to the format or rules of the relevant event(s), series, competition or race(s) as determined by the relevant sports or racing body; or
- a change in the location of any match, game, race or event.
1.17.2 Material changes to events declared by racing or sporting codes
Where a sporting or racing body announces or declares a material change to the structure of a competition, event or race (including, but not limited to, the number of players in match, matches or races in season or the time, location or date of the event(s) or race(s)), and Sportsbet considers (acting reasonably) that such change will have a material impact on a market or bet type taken on, or involving, that competition, event(s) or race(s), all bets on the affected market(s) may be voided by Sportsbet at its discretion (acting reasonably and as soon as reasonably practicable following a relevant announcement). All affected bets (including legs of multi bets) which rely on a number or series of matches or games occurring within a season which are cancelled, will be recalculated accordingly.
