TERMS AND CONDITIONS

1. Information on how to enter and the prize form part of these Terms and Conditions (“Terms”). Entry and participation in this promotion is deemed acceptance of these Terms and an acknowledgement of their binding effect.
   
   

2.  Entry is only open to and participants agree they are:

   • • Australian residents;
     • aged 18 years or over;
     • not self-excluded or registered with BetStop: and
     • not subject to a ban, exclusion or barring from Sportsbet.
       
       
3.  The Promotion will be conducted at Caulfield Racecourse, Caulfield East, Victoria on Saturday 19th October 2024.
   
   
4.  For the avoidance of doubt, all references to time in the Terms shall be construed as Australian  Eastern Standard Time (AEST), unless explicitly stated otherwise.
   
   
5.  Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any contestant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
   
   
7. Incomplete, indecipherable or illegible entries will be deemed invalid.
   
   VOLK’S $100K DELI PROMOTION
   
   
8.  Entries into the Volk’s $100K Deli Promotion (“the Promotion”) commence at 10:00AM AEST on Saturday 19 October 2024 and close at 3:00PM AEST on Saturday 19 October 2024 (“the Promotional Period”).
   
   
9.  The Promotion will occur at The Volk’s Deli Activation at Caulfield Racecourse, Gate 2, Station Street, Caulfield East VIC 3145 (Volk’s Deli).
   
   
10. Entrants will be deemed to have entered The Promotion, once they complete the provided entry form at Volk’s Deli during the Promotional Period (Entry). Entrants must provide their full name, mobile number and email address, in addition to an acknowledgement of these Terms. Failure to do so will render their entry invalid.
    
    
11. Entrants may be required to present a legal form of identification with their Entry to verify they are over the age of eighteen (18).  A failure to present a legal form of identification upon request will render the attempted Entry invalid.
    
    
12. Each participant is limited to one entry into the Promotion.
    
    PROMOTION PROCESS 
13. At the expiration of the Promotional Period (3:00pm), eighteen (18) entrants shall be randomly selected as contestants (Contestants) and thirty-two (32) additional entrants shall be selected as reserves (Reserves) by Efront. All entrants acknowledge and agree that their personal information (PI) collected in accordance with these Terms may be sent to OpenBet for verification.
    
    
14. Contestants will be notified by the Promoter of their selection via SMS, no later than 3:25pm.
    14.1      The notification SMS will instruct Contestants to meet a designated official of the Promoter at Volk’s deli by 3:50pm.
    14.2      A reminder SMS shall be sent to Contestants at 3:45pm.
    
    
15. If a Contestant fails to meet the designated official by 3:50pm, the Contestant shall forfeit the prize and any Winnings designated to them under the Promotion (Forfeit or Forfeiture).
    
    
16. All Contestants and entrants acknowledge that the Promoter’s determination of the accurate time is final and binding.
    
    
17. Contestants who fail to appear at the specified location and time shall be sent an SMS notifying them of their Forfeiture by 4:00pm. In the event of a Contestant’s Forfeit, the applicable number of Reserves will be called upon to replace the Forfeited Contestant. For the avoidance of doubt, the first Reserve selected randomly shall replace the first Contestant who Forfeits and so on.
    
    
18. Reserves selected to replace Contestants will be notified by SMS by 4:00pm.
    18.1     The SMS will instruct Reserves to meet a designated official of the Promoter at Volk’s Deli by 4:10pm.
    18.2     If a Reserve fails to meet the designated official at Volk’s Deli by 4:15pm, they shall Forfeit, and the Promoter shall repeat clause 17 until all horses are allocated to alternative Reserves.
    
    PRIZE
    
    
19. Upon timely presentation at Volk’s Deli, each of the eighteen (18) Contestants, and the applicable number of Reserves, if necessary, shall be brought onto a designated stage area. All parties acknowledge that Contestants and Reserves may not bring any third party with them onto said stage area.
    
    
20. Each Contestant will select one (1) of the eighteen (18) trophies placed on a table. Each trophy will display a unique number that corresponds to the saddlecloth number of a horse participating in the 2024 Sportsbet Caulfield Cup (Prize). The number will be displayed on the bottom of each trophy, so Contestants will not know which number is under each trophy when making their selection. Contestants and Reserves shall select their trophy in a random order, as instructed by the Promoter.
    
    WINNINGS 
    
    
21. The Contestant or Reserve who selects the Prize corresponding to the horse that places first in the 2024 Sportsbet Caulfield Cup shall be awarded $100,000 AUD (Major Winnings).
    
    
22. In the event of a dead heat involving two or more horses, the Major Winnings shall be divided equally among the Contestants (or Reserve as the case may be) holding the corresponding Prizes for each winning horse.
    
    
23. All other Contestants (or Reserve as the case may be) will receive a consolation prize of $1,000 AUD each (Consolation Winnings).
    
    GENERAL
    
    
24. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    
    
25. If a horse is scratched from the 2024 Sportsbet Caulfield Cup prior to the random draw occurring and there are fewer than eighteen (18) runners in the race, then the equivalent number of Contestants will be drawn to select a Prize.
    
    
26. If a runner in the 2024 Caulfield Cup is scratched after the random draw occurring (for example, as a late scratching prior to the running of the 2024 Sportsbet Caulfield Cup), the trophy representing the relevantly scratched horse will stand and the relevant entrant that selected that trophy will be unable to select an alternate trophy. For the avoidance of doubt the Contestant (or Reserve as the case may be) shall still receive a Consolation Prize of $1,000 AUD.
    
    
27. Upon their presentation to the designated representative at Volk’s Deli, all Contestants and any required Reserves agree to wear a Sportsbet branded bib for the remaining duration of the competition.
    
    
28. If the number of Contestants and Reserves that present themselves to Volk’s Deli at the required time, as determined by the Promoter, is less than the number of entrants in the 2024 Sportsbet Caulfield Cup, then the $100,000 AUD, the Major Winnings shall be awarded to the Contestant or Reserve whose horse finishes highest in the 2024 Caulfield Cup of the Prizes selected.
    
    
29. The Promoter shall use best endeavours to contact Contestants and Reserves in the event they have been randomly selected, however the Promoter shall not be responsible for any failure of communication, including but not limited to SMS messages not being received or being delayed due to technical issues. In such instances, the Promoter will not be liable for any losses and the entrant’s capacity to collect any Prize, Major Winnings or Consolation Winnings or any other benefit bestowed upon them under these Terms shall be rendered invalid.
    
    
30. If the 2024 Caulfield Cup is cancelled, or postponed to a day other then 19 October 2024, all Entry’s into the competition shall be rendered invalid and no Prize, Major Winnings or Consolation Winnings shall be awarded, regardless of whether a Prize has been selected already or not.
    
    

31. The Promoter’s decision is final and no correspondence will be entered into.

    Cash prizes will be awarded via EFT (electronic funds transfer) within twenty-eight (28) business days of being notified. Contestants and Reserves acknowledge that in order to collect any Prize or Winnings bestowed upon them under this Agreement, they will be required to submit their bank details to a nominated representative of the Promoter. A failure to provide such details upon request shall render their entitlement to any Prize or Winnings void. The Promoter will not be responsible for a banking institution rejecting an EFT payment, or any costs associated with locating any lost monies.
    
    
33. Total prize pool value during the Promotional Period is $117,000 AUD.  The prize is supplied and payable by Sportsbet.
    
    
34. Prizes, or any unused portion of a prize, are not transferable or exchangeable, unless otherwise specified.
    
    
35. Entrants consent to the Promoter and Victoria Amateur Turf Club (Incorporating The Melbourne Racing Club) ABN 96 267 203 634 (MRC) & TGI Sport  Marketing (Aust) Pty Ltd ABN 36 603 385 575 (TGI) using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
    
    
36. The Promoter may at its absolute discretion prohibit an entrant’s participation in the promotion, cancel or suspend a prize or otherwise cease to provide any prize to a winner if the entrant or winner (or any companion) is (in the Promoter’s opinion) under the influence of alcohol or drugs, behaves aggressively or disruptively, or behaves in a manner which may affect their ability to participate in the promotion, diminish the good name and reputation of the Promoter or its products and brands, or is contrary to law or is otherwise inappropriate.
    
    
37. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
    
    
38. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
    
    
39. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) taking of the prize.
    
    
40. The Promoter collects PI in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers which for the avoidance of doubt includes, but is not limited to TGI and Efront Pty Ltd ABN 73 131 970 137 (EFront) and OpenBet Asia Pacific Pty Ltd ABN 55 137 114 302 (OpenBet). PI includes but is not limited to full name, date of birth, mobile number address and email. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://helpcentre.sportsbet.com.au/hc/en-us/articles/115004971088-Sportsbet-s-Privacy-Policy.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s PI to any entity outside of Australia.
    
    
41.  The Promoter is Sportsbet Pty Ltd (ABN 87 088 326 612) of Level 15, 367 Little Collins Street, Melbourne VIC 3000, telephone 1800 990 907 and any of its affiliates, assigns, licensors, other related companies and agencies, which for the avoidance of doubt includes TGI.
